Standards and reporting

CSDDD

The CSDDD is a corporate due-diligence directive, so preparation starts with the amended legal route and the actions needed to address impacts rather than a sustainability-report template.

What does the CSDDD concern?

The directive addresses actual and potential adverse human-rights and environmental impacts through a due-diligence process rather than merely an annual account of policies Articles 1 and 5.

Follow the impactRequirements and evidence

Module 01 / 04

Route

Identify the company and applicable scope provision.

Read the detailed guidance and evidence

The Commission’s overview is useful orientation, but the consolidated directive and the adopted Omnibus amendment control the current legal reading Commission due-diligence overview Directive 2026/470.

The standards overview separates due diligence from reporting, while CSRD explained identifies the distinct sustainability-statement route.

Which scope facts need to be distinguished?

The amended scope has EU, third-country and group/franchise routes rather than a universal supplier-size test.

Original editorial preparation record, not a prescribed government form.
Evidence questionRecord to inspectDecision supported
EU companyEmployees and worldwide turnover under Article 2(1)Whether the relevant cumulative conditions are met
Third-country companyUnion turnover and the Article 2(2) reference yearWhether the separate non-EU route applies
Parent or franchise routeGroup relationships and the relevant limbWhether an alternative condition must be assessed
PersistenceThe two relevant consecutive financial yearsWhether scope entry or exit conditions are satisfied
Read the detailed guidance and evidence

The principal EU limb requires more than 5,000 average employees and more than €1.5 billion net worldwide turnover, while the main third-country limb uses Union turnover without that employee test Article 2.

These are not the CSRD’s thresholds, so a CSRD scope conclusion cannot simply be copied into the due-diligence file.

Which implementation stage should a current preparation plan describe?

Adoption, national transposition and company application have separate roles, with an additional reporting timetable Article 37 Articles 4–6.

Name the actual stageRequirements and evidence

Module 01 / 04

Adopted text

Use the directive as amended rather than an earlier proposal.

Read the detailed guidance and evidence

National measures are due by 26 July 2028 and apply from 26 July 2029, with Article 16 measures applying for financial years beginning on or after 1 January 2030 Article 37(1).

A UK supplier receiving a questionnaire now should distinguish the customer’s commercial request from a claim that every CSDDD obligation already applies to that supplier.

The CSRD Omnibus guide helps prevent a scope or reporting date from another part of the legislative package being reused here.

How should a supplier evidence request be framed?

Identify the purpose and missing information before sending the same questionnaire to every business partner.

Original editorial preparation record, not a prescribed government form.
Evidence questionRecord to inspectDecision supported
PurposeImpact or question the customer is investigatingWhy the request is relevant
Existing informationWhat the customer can reasonably obtain elsewhereWhether a further request is necessary
Partner sizeThe relevant Article 8(2a) assessmentHow the information-request limitation is considered
ResponseEvidence, limitation and responsible personWhat the customer can reasonably infer
Read the detailed guidance and evidence

Article 8(2a) limits requests to business partners with fewer than 5,000 employees where the necessary information cannot reasonably be obtained by other means Article 8(2a).

The CSRD cap and its voluntary-standard datapoints concern a different reporting purpose, so they should not be presented as the CSDDD questionnaire rule Commission cap explanation Regulation 2026/1560.

How does the amended identification process affect preparation?

The current text uses a scoping exercise followed by focused in-depth assessment rather than systematic entity-level investigation of every partner Article 8(2) Recital 39.

Focus the investigationRequirements and evidence

Module 01 / 04

Scoping

Use reasonably available information to identify general areas.

Read the detailed guidance and evidence

A single supplier risk score may help organise work without explaining why a particular activity or allegation needs investigation.

The OECD Guidelines and UN Guiding Principles provide recognised responsible-business context, but a voluntary framework description is not a substitute for the directive’s actual provisions OECD Guidelines UN Guiding Principles.

The double materiality guide serves a reporting assessment rather than automatically completing this due-diligence process.

How could a fictional buyer investigate a specific allegation?

Fictional case: Brackenwell Components receives credible concerns about recruitment fees at a supplier’s subcontracted facility.

Original fictional risk investigation, not legal advice or a prescribed audit procedure.
Evidence questionRecord to inspectDecision supported
General supplier score is lowThe allegation concerns a specific activityRetain the allegation rather than dismiss it through the average score
Supplier policy prohibits feesEvidence of implementation remains uncertainInvestigate recruitment records and affected-worker accounts
Audit summary reports no issueIts population and timing are unclearReview what the audit actually covered
Management proposes closing the caseThe underlying concern remains unresolvedRecord the investigation and action still required
Read the detailed guidance and evidence

Brackenwell’s evidence problem is a mismatch between a generic assurance and a specific affected-worker concern, not merely an empty questionnaire field.

The fictional case illustrates preparation choices without making a finding that any real company caused harm or owes compensation.

Does any supplier allegation mean the buyer must pay compensation?

The remediation provision distinguishes impacts caused or jointly caused by the company from those caused only by a business partner Article 12.

Assess the relationshipRequirements and evidence

Module 01 / 04

Impact

Establish what actual adverse impact is supported.

Read the detailed guidance and evidence

Article 12 requires remediation where the company caused or jointly caused the actual impact, while partner-only impacts have a different treatment that can involve voluntary remediation or use of influence Article 12(1)–(2).

That distinction does not eliminate other due-diligence obligations, and a preparer should not use it to close an unresolved case without investigating the relevant connection.

The modern slavery statement guide addresses the separate UK account of steps taken rather than an equivalent remediation regime.

What makes an action record useful?

An editorial case record should show what the response tried to change and what evidence would demonstrate progress.

Original editorial preparation record, not a prescribed government form.
Evidence questionRecord to inspectDecision supported
Action purposeSpecific concern or impact addressedWhether the response relates to the actual issue
Responsible partyDecision owner and participating organisationsWho can implement or influence the response
Evidence of changeRecords or affected-person feedbackWhether the response changed the situation
Unresolved limitationRemaining concern and next reviewWhy the matter remains open or is closed
Read the detailed guidance and evidence

A contractual assurance and a completed training session may be useful evidence without by themselves establishing that the adverse impact has ended.

The Home Office guidance similarly warns against relying on audits alone in the UK statement context, which is a useful evidence caution rather than a replacement CSDDD rule Practical guide, audits and inspections.

What must not be confused with CSDDD compliance?

Keep the sustainability statement, UK modern-slavery statement and due-diligence response as distinct outputs with their own legal bases.

Separate the outputsRequirements and evidence

Module 01 / 04

CSRD

A reporting route using ESRS content.

Read the detailed guidance and evidence

Section 54 requires a statement for organisations meeting its test, with the £36 million threshold set in separate regulations, rather than making the CSDDD process a universal UK obligation Modern Slavery Act section 54 SI 2015/1833.

A buyer should therefore state which output a piece of supplier evidence supports instead of telling every small business that it must comply with every framework mentioned in the questionnaire.

Which older summaries need an explicit status correction?

Use a dated change record so a previous project requirement does not survive after the governing provision changes.

Original editorial preparation record, not a prescribed government form.
Evidence questionRecord to inspectDecision supported
Former climate-plan dutyArticle 22 deletionRemove the claim that CSDDD still requires that plan
Earlier scope figuresAmended Article 2Reassess the actual route
Former phased applicationCurrent Article 37Use the amended national and application stages
EU-wide liability claimAmended Article 29Distinguish national-law liability and surviving safeguards
Read the detailed guidance and evidence

Omnibus deleted Article 22 in full and removed the harmonised cause of action, so “softened transition-plan duty” and “automatic EU-wide civil claim” are not accurate summaries of the current text Article 4(16) and (20).

What would a useful original case register contain?

Design the register around a specific impact question and its resolution rather than a universal supplier pass/fail badge.

Preserve the case historyRequirements and evidence

Module 01 / 04

Signal

Allegation, source and activity concerned.

Read the detailed guidance and evidence

Brackenwell’s planned register keeps the original allegation, the audit-coverage limitation and the reason further inquiry remained necessary.

Access and personal-data handling need deliberate controls rather than copies of sensitive worker accounts distributed through every supplier workbook.

A software RFP can test whether an altered case decision retains earlier evidence and the reviewer’s rationale.

What should the programme sponsor accept?

A defensible preparation handover makes the scope, investigation and unresolved decisions explicit.

Original editorial preparation record, not a prescribed government form.
Evidence questionRecord to inspectDecision supported
Legal routeCompany, group and national implementation assessmentWhat is being prepared and why
Case evidenceActivities, sources and conflictsWhat the assessment actually considered
Response decisionsActions and their connection to the concernWhat management decided to change

Read the detailed guidance and evidence

The CSRD consultancy guide helps define related reporting work, while a due-diligence engagement needs its own scope rather than a promise that statement drafting completes operational responsibilities.

The Commission overview should be monitored for owner guidance, but a planned guideline is not the same as an adopted change to the directive Commission due-diligence page.

What if contrary evidence arrives after management closes the case?

A closure decision should retain its evidential basis so new information can be assessed against the earlier conclusion.

Reassess the closureRequirements and evidence

Module 01 / 04

Record the new information and its source.

Read the detailed guidance and evidence

Brackenwell receives a worker account that concerns a recruitment channel omitted from the audit population, after management has marked the supplier case complete.

The team should preserve the earlier decision while investigating the new scope issue rather than reject the information because the dashboard already shows a closed case.

This editorial test supports review of the evidence and effectiveness of measures without prescribing a universal case-closing score Articles 8 and 15.

How can the team prepare a reviewable evidence file?

Frequently asked

Questions people ask

Is CSDDD the same as CSRD?

No, CSDDD concerns due diligence while the CSRD route concerns sustainability reporting, with different scope and application provisions.

When does the amended CSDDD apply?

National measures apply from 26 July 2029, with Article 16 reporting measures for financial years beginning from 1 January 2030.

Does every UK supplier fall within CSDDD?

No, distinguish the third-country scope tests from a commercial evidence request received from an in-scope customer.

Does the directive still require a climate transition plan?

No, the Omnibus amendment deleted Article 22 rather than merely relaxing it.

Can the CSRD cap be applied to every due-diligence question?

No, distinguish the reporting cap from CSDDD’s own information-request provisions.

Does an allegation automatically establish buyer liability?

No, the actual impact, relationship, remediation provision and national-law liability basis need separate assessment.
